Feel like you deserve to be taken advantage of if you're the sort of person who enjoys taking pictures of your food while sitting in a restaurant.

And then uploading them to a site that explicitly claims ownership of them, and then complaining about it. I'm assuming Metro Jacksonville had Yelp's permission to use the photos?

Lol. I can't say that I don't think the guy's concerns aren't valid. I ask that people credit me or MJ when using my work as well. I typically use my own photos. When I don't, I credit the sources and include links back to their sites. I also believe it's bad ediquette to copy and paste full articles on the forums from other sites without their consent.

I believe issues like the yelp thing can be resolved in the copy editing phase before all articles run. That's something I've been personally working on with others "behind the scenes" on over the last two months.

It's not that Yelp claims ownership of the images. Essentially, when you upload an image to yelp you place it in the public domain. That's how I read their terms and conditions.

Nevertheless, it's a good practice to reach out to the reviewers. They do a lot hard work and should receive acknowledgment for their efforts.

They don't claim "ownership" as in it belongs to them and not to you. However they do claim the rights to use things you post in various ways (emphasis mine):

Quote
We may use Your Content in a number of different ways, including publicly displaying it, reformatting it, incorporating it into advertisements and other works, creating derivative works from it, promoting it, distributing it, and allowing others to do the same in connection with their own websites and media platforms ("Other Media"). As such, you hereby irrevocably grant us world-wide, perpetual, non-exclusive, royalty-free, assignable, sublicensable, transferable rights to use Your Content for any purpose. Please note that you also irrevocably grant the users of the Site and any Other Media the right to access Your Content in connection with their use of the Site and any Other Media. Finally, you irrevocably waive, and cause to be waived, against Yelp and its users any claims and assertions of moral rights or attribution with respect to Your Content. By "use" we mean use, copy, publicly perform and display, reproduce, distribute, modify, translate, remove, analyze, commercialize, and prepare derivative works of Your Content.

Yelp claims the right to let "Other Media" use the content. They way I read this is that a site would need Yelp's permission to use the content on their own sites or outlets. I assumed Metro Jax had Yelp's permission to use the photos, which sounds like it's not the case. Looking at the two articles, the pictures aren't attributed even to Yelp, let alone the user who created them. Definitely bad etiquette to quote Ennis. The moral of the story is (1) don't upload your pictures to a website if you don't want them to be used, and (2) you didn't take the picture, credit the person who did, especially on a site like this that brings in money.

Ya'll effers have some brass balls to be stealing this master's work.

Your lip service about better copy editing would probably ring more sincere, Ennis, if it weren't typed from the deck of the waterfront home that you no doubt purchased using proceeds from Steve "Lemon 10" M's blurry iPhone 3Gs photos of cabbage stew.

I have photos of Shoppes of Avondale Biscotti's scene; glass of La Fin du Monde next to a giant slice of carrot cake......priceless and nobody could care less.

Attribution is all you need. Links are better, but attribution is important.

Who is "that guy" at MJ he keeps referring too?

Solution: Something like this should be posted in articles for all pictures that aren't taken by Metro Jacksonville:

"Photo courtesy of Steven Moran. at whatever URL the image came from" and call it day.....or just don't use it.

To be honest, this is the type of crappy images that clutter up our photo collection at Smugmug.  It would be cool to add a photo gallery to the site but we'll first have to separate the good stuff we own from the random low quality third party uploads.

A scandal and Stephen Dare wasn't involved?! That is a scandal in itself!

Lake, I believe you can have hidden albums on Smugmug that you can still use links from for posting on Met Jax. Its been a while since I used them, but I seem to remember that feature.

I was wondering when the fight against MJ would emerge. It won't be before long now that this dope on yelp joins in with other to shut MJ down, if they haven't already started. I can imagine MJ being hated by those of yelp man's stereotype and those that fit the profile.

He seems like one of those guys that you need around you when the world falls apart. He's here for the end of civilization and I'd like to be his friend.
